Ending a marriage is a tough decision and the process of getting divorced can create a hundred even more difficult decisions. How do you resolve all these complex issues? How do you know if you are getting your fair share? How do you stand your ground without an emotionally and financially draining courtroom fight?

At the law firm of Sheridan & Dulas, P.A., we believe that information is power. We work to demystify the divorce process by giving our clients the answers and perspective they need to understand their options, make meaningful decisions based on the facts and the law, and engage in proactive and productive negotiations to avoid costly legal proceedings.

Protecting Your Interests When It’s Time To Part Ways

We help you define your goals and pick your battles wisely. We equip you to think long-range and to drive a fair and practical settlement. We work to give you the tools to make decisions for your own life and your own family.

We also realize that sometimes the resolution of your issues cannot be accomplished cooperatively. Sometimes the issues themselves are too complex or perhaps the other party is difficult or not open to an amicable process. Our lawyers are able to forcefully advocate for you when any aspect of your divorce must be settled in court.

Divorce And Property Division: Getting Your Share Of The Marital Pie

Our philosophy is to give clients the information they need to make good decisions. We will explain Minnesota’s divorce process and equitable distribution law so that you know what to expect. We want you to understand the big picture while we also focus on the details that are important to you now and in the long term.

We start with an inventory of your assets and liabilities to determine what is marital versus non-marital property. Not all assets are divided in a divorce; some assets are the property of only one spouse and are not considered in the division. Understanding what is subject to the process and the rules that determine what is non-marital property can have a big impact on the outcome of your case. When parties can not agree on what is marital or non-marital property, it may be necessary to have the court rule on whether a particular asset is marital or non-marital.

Next, we work with you to determine the current value of the assets and liabilities for purposes of division. We may bring in valuation experts with regard to some items of the disputed property. This is especially important in high-asset divorces in which accurate valuations of real property, investments or small business could change the figures by hundreds of thousands of dollars

Once the total value of the marital estate is known, we will analyze the situation and discuss with you the strengths and weaknesses of your case so that you have a good understanding from the beginning of the range of possible outcomes of the different aspects of your divorce. This includes but is not limited to such considerations as:

  • Your house
  • A cabin property or other real estate
  • Pensions and retirement accounts
  • Stocks and investments
  • Business interests
  • Automobiles and recreational vehicles
  • Collections and personal property
  • Debts and liabilities

We also address spousal maintenance and custody/parenting time as they may apply to living arrangements, the financial resources of each party, and the overall divorce settlement or decree.
