We start with an inventory of your assets and liabilities to determine what is marital versus non-marital property. Not all assets are divided in a divorce; some assets are the property of only one spouse and are not considered in the division. Understanding what is subject to the process and the rules that determine what is non-marital property can have a big impact on the outcome of your case. When parties can not agree on what is marital or non-marital property, it may be necessary to have the court rule on whether a particular asset is marital or non-marital.
Next, we work with you to determine the current value of the assets and liabilities for purposes of division. We may bring in valuation experts with regard to some items of the disputed property. This is especially important in high-asset divorces in which accurate valuations of real property, investments or small business could change the figures by hundreds of thousands of dollars
Once the total value of the marital estate is known, we will analyze the situation and discuss with you the strengths and weaknesses of your case so that you have a good understanding from the beginning of the range of possible outcomes of the different aspects of your divorce.
